Consulting on the new Mental Health and Wellbeing Act

The Department of Health has begun consultation on the development of a new Mental Health and Wellbeing Act, as recommended by the Royal Commission.
While legislation cannot achieve everything alone, the new Act will be critical in establishing the right foundation for the new mental health and wellbeing system. To assist the Department of Health in its consultation period, the Victorian Healthcare Association (VHA) and Mental Health Victoria (MHV) will be running consultation workshops on 19 and 21 July.
VHA members are invited to participate.
Consultation will cover the following areas of the new Act:
- objectives and principles
- non-legal advocacy supports
- supported decision-making
- information sharing
- compulsory treatment
- seclusion and restraint
- governance and oversight

The VHA has prepared a member briefing to summarise the Update and Engagement Paper and help members understand what is being proposed in the new Act. We recommend participants read the briefing in preparation for attendance at the workshops.
